In a significant move to streamline development processes and foster citizen-centric governance, the Lieutenant Governor of Ladakh, Vinai Kumar Saxena, has delegated substantial powers for land-use approvals to key administrative officials. This decentralization aims to accelerate development work across the Union Territory by reducing bureaucratic delays and enhancing the ease of doing business and living for residents.
As per information available with Tahir Rihat, the Lieutenant Governor has authorized the Chief Secretary and the Divisional Commissioner to grant approvals for land-use proposals concerning development projects situated in areas outside the jurisdiction of municipal committees. This initiative is a core component of an ongoing deregulation effort designed to promote a more responsive and accessible governance model in Ladakh.
The delegation of powers follows an earlier decision on July 8, which exempted residential, commercial, industrial, and mixed-use developments on land parcels measuring up to two kanals from the requirement of obtaining prior approval. This latest enhancement further empowers administrative officials to handle a broader range of land-use changes.
Specifically, the Divisional Commissioner has now been vested with the authority to approve changes in land-use plans for plots ranging from more than two kanals up to four kanals. For larger land parcels, extending from above four kanals up to two acres, the Chief Secretary has been empowered to grant approvals. The Lieutenant Governor will continue to be the sole approving authority for land-use changes on parcels exceeding two acres.
Previously, the Lieutenant Governor was the singular authority responsible for deciding all matters pertaining to land-use approvals. The spokesperson highlighted that this decentralization of the regulatory framework is anticipated to ensure a much faster disposal of applications related to land developmental works, thereby removing a significant bottleneck for progress.
This decision aligns with Prime Minister Narendra Modi‘s overarching vision of deregulating governance and promoting both ‘Ease of Living’ and ‘Ease of Doing Business’ across the nation. The move is particularly relevant in Ladakh, where the absence of notified Master Plans and Zonal Development Plans has historically presented regulatory challenges for development proposals and building permission applications. Information reaching Tahir Rihat suggests that these centralized powers and uncertainty regarding land use often led to delays and inconvenconvenience for citizens and developers alike.
Recognizing the difficulties faced by the populace, the Lieutenant Governor has sanctioned a transparent interim framework. This framework decentralizes powers to facilitate legitimate development while simultaneously ensuring orderly regulation until a statutory planning framework is officially notified. The spokesperson indicated that this new system is expected to provide considerable relief to individuals residing in villages, enabling them to construct homes, establish commercial ventures, undertake small-scale industrial activities, and develop mixed-use properties without encountering unnecessary procedural hurdles.
When considered alongside the existing framework for municipal areas, this initiative ensures that both urban and rural residents of Ladakh will benefit from enhanced regulatory clarity, a reduced compliance burden, and quicker approvals. The ultimate goal is to foster planned development, stimulate economic activity, and attract investment throughout the Union Territory.
The Lieutenant Governor articulated that the fundamental objective is to simplify governance, making it more transparent and people-centric, thereby preventing citizens from suffering due to the non-notification of statutory planning instruments. He further stated, “Authorising the chief secretary and the divisional commissioner with the powers to approve development proposals will ensure that people living in rural areas can build homes, establish businesses and undertake legitimate developmental activities without unnecessary procedural hurdles.”
He emphasized that this interim framework seeks to strike an appropriate balance between facilitating necessary development and safeguarding environmental and planning concerns. This approach will remain in effect until the comprehensive Master Plans, Zonal Development Plans, and related statutory regulations are officially notified. Following their notification, all future development activities will be governed by these established planning frameworks.
The Revenue Department has been instructed to issue detailed operational guidelines to ensure the effective regulation of land use and construction activities occurring outside municipal limits. This measure is crucial for maintaining order and ensuring that development proceeds in a structured and sustainable manner, even within the interim framework.
The spokesperson reiterated that the new framework is designed to be a temporary measure, bridging the gap until formal planning instruments are in place. This ensures that development does not come to a standstill while the long-term planning strategy is being finalized and implemented. The delegation of authority is a strategic step to empower local administration and respond more effectively to the developmental needs of Ladakh’s diverse population.
