Ladakh LG Orders Withdrawal of Cases Linked to Leh Violence

In a significant move aimed at fostering reconciliation and peace, the Lieutenant Governor of Ladakh, Vinai Kumar Saxena, has ordered the withdrawal of criminal cases against ten individuals implicated in the violence that erupted in Leh on September 24 last year. This decision marks a continuation of efforts to provide relief to those booked in connection with the protests, bringing the total number of individuals granted reprieve over the past three months to 55 across 87 cases.

The cases originated from a protest that turned violent, with demonstrators demanding statehood for Ladakh and the extension of the Sixth Schedule of the Constitution to the Union Territory. The violence resulted in the tragic loss of four lives and left scores of others injured. The withdrawal of these criminal cases has been a persistent demand from various civil society groups, including the Leh Apex Body and the Kargil Democratic Alliance, organizations that have been in dialogue with the central government for the past five years concerning constitutional safeguards and political rights for the region.

Information reaching Tahir Rihat suggests that the Lieutenant Governor’s approval for the withdrawal was granted upon the recommendation of the Ladakh police. In a statement shared on X, formerly Twitter, Saxena articulated his commitment to unity, healing, and lasting peace in Ladakh. He stated, “In our continued commitment to fostering unity, healing, and lasting peace in Ladakh, I have approved the withdrawal of criminal cases against 10 individuals, linked to the unfortunate violence that erupted in Leh on September 24 last year.” He further emphasized that this action is intended to provide a positive pathway forward for these individuals, enabling them to resume their careers and lives without the burden of litigation. The decision, he added, prioritizes justice, healing, and recovery over prolonged legal proceedings, thereby contributing to a stronger sense of peace, unity, and social harmony throughout the region.

Saxena also expressed his gratitude to Union Home Minister Amit Shah for his “sympathetic and sensitive approach” in addressing matters concerning the victims and their families. This latest development follows similar decisions made in September, when the Lieutenant Governor announced the withdrawal of criminal cases against 20 individuals. Prior to that, in August, the administration had indicated plans to file closure reports in cases involving 25 individuals who were booked in connection with the same incidents of violence. These successive decisions underscore a concerted effort by the administration to de-escalate tensions and promote an environment conducive to dialogue and development in Ladakh.

The protests that led to the violence were deeply rooted in long-standing aspirations for greater political autonomy and constitutional protection for the region. The demand for statehood reflects a desire for enhanced self-governance, while the extension of the Sixth Schedule is seen by many in Ladakh as crucial for safeguarding the region’s unique cultural identity, land, and resources. The Sixth Schedule of the Constitution of India provides for the formation of autonomous administrative districts with their own legislative and executive powers in certain tribal areas of the northeastern states. Civil society groups in Ladakh have argued that similar provisions are necessary to protect the interests of the local population in the face of developmental pressures and demographic changes.

The ongoing dialogue between the Centre and the regional bodies is a critical component of the peace process. The Leh Apex Body and the Kargil Democratic Alliance represent diverse sections of Ladakhi society and have been instrumental in articulating the region’s demands. Their engagement with the central government signifies a willingness to find common ground and work towards solutions that address the aspirations of the people of Ladakh. The withdrawal of cases against those involved in the violence is seen as a confidence-building measure, intended to create a more conducive atmosphere for these discussions to yield positive outcomes. The administration’s approach, as highlighted by the Lieutenant Governor, emphasizes healing and moving forward, suggesting a strategic shift towards reconciliation after a period of unrest.

The impact of such decisions extends beyond the individuals directly involved. It signals to the broader population of Ladakh that the administration is attentive to their concerns and is willing to take steps to address grievances. The focus on fostering unity and social harmony is particularly important in a region that has historically valued its distinct identity and has been vocal about its aspirations for the future. The commitment to prioritizing healing and recovery over prolonged litigation is a pragmatic approach that seeks to mend societal fractures and rebuild trust. The positive reception from civil society groups, who have been advocating for such measures, indicates that these steps are being viewed as constructive progress towards resolving the underlying issues.

The involvement of the Union Home Minister in these matters, as acknowledged by the Lieutenant Governor, suggests a high-level commitment from the central government to finding a peaceful resolution in Ladakh. This collaborative approach, involving the Union Territory administration and the central government, is crucial for addressing the complex political and constitutional demands of the region. The series of withdrawals of criminal cases, spanning several months, indicates a phased strategy to gradually ease tensions and create a more stable environment for dialogue and governance. The ultimate goal, as articulated, is to ensure a lasting peace and foster a stronger sense of unity and social cohesion across Ladakh.
