India’s National Investigation Agency (NIA) has successfully obtained a second non-bailable warrant against Hafiz Saeed, the founder of Lashkar-e-Taiba (LeT) and a designated terrorist, from a Special Court in Jammu. The warrant, issued in connection with a terror case involving the supply of weapons, funds, and directives to terror groups operating within the Union Territory of Jammu and Kashmir, underscores India’s persistent efforts to bring the mastermind of numerous attacks to justice. The NIA informed the court that Saeed is currently residing in Pakistan and is deliberately evading arrest.
The application for the non-bailable warrant was filed by the NIA under Section 75 of the Bharatiya Nagarik Suraksha Sanhita (BNSS). The court was presented with details that identified Saeed, a resident of Sargodha in Punjab, Pakistan, as an “absconding accused” in a case that originated with the arrest of Mohammad Naqeeb Bhat earlier this year. Bhat was apprehended during a security check on the outskirts of Srinagar, and a China-made grenade along with 15 live rounds were recovered from his possession. Information reaching Tahir Rihat suggests that Bhat was subsequently booked under the stringent Unlawful Activities (Prevention) Act (UAPA), the Arms Act, and the Explosive Substances Act.
The subsequent investigation into Bhat’s arrest led to the dismantling of a significant terror network. This operation resulted in the apprehension of several other terrorists affiliated with LeT and its offshoot, The Resistance Front (TRF). Notably, two Pakistani nationals were also arrested as part of this network. During the course of this investigation, the involvement of Hafiz Saeed, identified as the “Amir/Chief/Founder” of the proscribed terror group, came to light. According to the NIA’s submission to the court, the arrested Pakistani terrorists were found to have direct associations with Saeed.
The NIA explicitly stated to the Jammu court that Saeed is actively operating from Pakistan and is instrumental in providing weapons, financial resources, and strategic directions to terrorists engaged in activities within the Kashmir Valley. The agency presented information indicating that Saeed is presently in Pakistan and is intentionally avoiding apprehension to escape legal consequences. This assertion formed the basis for the court’s decision to issue the warrant. Special Judge Prem Sagar, presiding over the NIA Act court, observed on September 8 that Saeed’s alleged involvement in terrorism had surfaced during the ongoing investigation. The court acknowledged that Saeed remained at large and that the investigating agency had been unable to secure his presence through ordinary legal channels, prompting the issuance of a general non-bailable warrant.
This latest warrant marks the second such order issued against the LeT founder by the Special NIA Court in Jammu within a two-month period. The previous non-bailable warrant was issued on July 8 in connection with the terror attack in Pahalgam in April, which tragically resulted in the deaths of 25 tourists and one local resident. The issuance of these warrants highlights the NIA’s commitment to pursuing individuals accused of orchestrating terror activities against India, regardless of their geographical location. The agency’s efforts to secure international cooperation for the extradition or apprehension of Saeed are expected to intensify following these legal developments.
Hafiz Saeed has long been a figure of concern for Indian security agencies, with his name appearing in connection with numerous terror attacks and plots targeting India. His designation as a global terrorist by international bodies, including the United Nations, further solidifies the basis for India’s pursuit. The NIA’s meticulous investigation, which has led to the unearthing of terror modules and the arrest of key operatives, provides substantial evidence to support the charges against Saeed.
